About this policy

This Privacy Policy explains how Akinary Pty Ltd (ABN 94 687 617 385) (“Akinary”, “we”, “us” or “our”), a company based in Queensland, Australia, handles personal information collected through the Akinary corporate website at https://akinary.com.au, including enquiries submitted through our contact form.

We handle personal information in line with the Australian Privacy Principles. Where the Privacy Act 1988 (Cth) applies to us, including where applicable under government contracts, we comply with it.

This Privacy Policy applies to the Akinary corporate website and services expressly covered by it. Products, platforms, brands or other businesses operated by Akinary Pty Ltd may have separate privacy policies reflecting how those products or services handle personal information. Where a separate privacy policy is provided, that policy applies to the relevant product or service. This does not change the legal obligations that apply to Akinary Pty Ltd.

Where we deliver project or client work, the handling of information in that work (including any personal information within client systems or data) may be governed by a separate agreement with the relevant client.

What we collect

When you submit an enquiry through our contact form, we collect the information you provide, which may include:

  • your name, work email address, organisation, role and country
  • your phone number, if you choose to provide it
  • details of your enquiry, such as the enquiry type, what you are trying to achieve, project stage, existing environment, approximate budget, timeframe and any important date or deadline
  • government or procurement details, where relevant to your enquiry
  • partnership or collaboration details, where relevant to your enquiry
  • your confirmation that you have read this Privacy Policy when you submit the form

When you use the website, technical information such as your IP address, browser and device details, and the pages or resources requested may also be processed to deliver and secure the website (see Why we collect and use it and Hosting and service providers).

If you email us directly, we collect the information contained in your email.

How we collect it

We collect personal information directly from you when you complete our contact form or otherwise contact us. Contact-form enquiries are sent to us by email. They are not currently stored in a website application database.

Why we collect and use it

We collect and use personal information to:

  • review and respond to your enquiry
  • understand your requirements and, where appropriate, discuss or prepare a proposal
  • communicate with you about your enquiry or a potential engagement
  • operate, maintain and secure the website, including preventing spam and misuse
  • meet legal, accounting, security or record-keeping obligations

Spam prevention and security. To limit automated or abusive submissions, the website applies a short-lived rate limit to contact-form submissions based on the submitting IP address. The IP address is held temporarily in server memory for this purpose and is not written to a website database.

Sensitive information

Please do not include sensitive personal information, identity documents, health information or financial account details in a general website enquiry unless specifically requested by Akinary.

Hosting and service providers

We use third-party service providers to operate the website and our business email, including:

  • Website hosting: the website is hosted by Vercel. Our deployment uses Vercel’s Sydney region for server functions; however, Vercel is an international provider and its platform, network, logging and support functions may involve processing outside Australia.
  • Business email: Akinary uses Zoho Mail for business email, including receiving website enquiries. Zoho has confirmed that data associated with our account is stored in Australian data centres, and our Zoho account identifies Australia as its data-storage location. As with other international service providers, support, subprocessors, backups or ancillary processing may involve other locations where applicable.

These providers may process personal information, including technical information such as IP addresses, as necessary to provide their services to us. We may also disclose personal information where required or authorised by law, or to professional advisers where reasonably necessary.

Overseas processing and disclosure

Some of our service providers operate internationally. Although our website server functions use an Australian region and our business email account data is stored in Australian data centres, personal information may be accessed, stored or processed outside Australia by our providers, including in the United States, for purposes such as platform operation, support, subprocessing, backups, security and service delivery. We take reasonable steps to use reputable providers, but overseas recipients may be subject to different privacy laws from those that apply in Australia.

Cookies and analytics

Our website does not currently use cookies for tracking or advertising, and we do not currently use analytics services or third-party marketing scripts. If this changes, we will update this policy and take any additional steps required by applicable law.

Security

We take reasonable administrative, technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. No method of transmitting or storing information over the internet is completely secure, and we cannot guarantee the security of information you send to us.

Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to manage our relationship with you, and to meet legal, accounting, security or record-keeping obligations. We apply internal retention guidelines to enquiries and business correspondence, and when personal information is no longer needed we take reasonable steps to delete or de-identify it.

Access, correction and deletion

You may ask to access the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. You may also ask us to delete personal information we hold about you, and we will do so where we are not legally or operationally required, or otherwise entitled, to retain it.

To make a request, email privacy@akinary.com.au. We may need to verify your identity before acting on a request. If we cannot give you access to, correct or delete your information, we will explain why where we are able to.

Direct marketing

We use contact details submitted through the website to respond to your enquiry. If we send you marketing communications, you can opt out at any time by emailing privacy@akinary.com.au or by using any unsubscribe option provided, and we will respect that request.

Anonymity and pseudonymity

You may browse our website without telling us who you are. Where practicable, you may also ask general questions without identifying yourself. However, to respond to a project enquiry we generally need your name, contact details and information about your organisation.

Data breaches

Where applicable, Akinary will assess suspected data breaches and comply with notification requirements that apply under relevant law.

International users and engagements

Akinary Pty Ltd is based in Queensland, Australia. We work with organisations in Australia and, where delivery arrangements and project requirements permit, in international markets. Whether we can take on a particular engagement depends on the legal, privacy, regulatory, contractual, tax, sanctions and export-control, and security or data-residency requirements that apply to it, and we may decline work where we cannot meet those requirements.

If you contact us from outside Australia, your information will be handled as described in this policy, including the overseas processing section.

EU, EEA and UK

We do not currently direct our services or marketing to individuals in the European Union, European Economic Area or United Kingdom. Enquiries from organisations in those regions may be considered case by case. We may decline engagements that require data-protection arrangements we do not currently have in place.

Privacy complaints

If you have a concern about how we have handled your personal information, please email privacy@akinary.com.au and explain your concern. We will investigate it and respond within a reasonable time.

Where the Privacy Act applies, if you are not satisfied with our response you may have the right to complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Changes to this policy

We may update this Privacy Policy from time to time, for example if our website, service providers or legal obligations change. The updated policy will be published on this page with a new “Last updated” date.
